Consumer Health Data Privacy Policy

Last updated:

This policy explains how Berine Metabolic LLC (“Berine,” “we,” “us”) collects, uses, and protects consumer health data through the Berine Metabolic platform, and the rights you have in that data. It supplements our Privacy Policy and is written to meet state consumer health data laws, including Washington’s My Health My Data Act and Nevada’s consumer health data law.

1. Consumer health data we collect

Consumer health data is personal information that identifies, or could reasonably be linked to, your past, present, or future physical or mental health. We collect the following categories, and only when you choose to provide them:

  • Diagnosis status you report, such as type 2 diabetes, prediabetes, or a new diagnosis.
  • Numbers you log in the course, such as glucose readings.
  • Your answers to self-assessments.
  • Notes and reflections you write in the course.

Because Diabetes Foundations is a diabetes-education course, the fact that you have enrolled and your progress through it may also suggest information about your health. We treat that information with the same care, as described below.

2. Where it comes from

We collect consumer health data only from you, when you enter it in the course. We do not obtain it from other companies, devices, or apps.

3. How we use it

We use consumer health data only to provide the in-course tools you choose to use: saving your entries, showing your progress, and powering in-course review. We do not use it for marketing or advertising, we do not send it to our analytics provider, and we do not use it to train third-party AI models.

We ask for your consent before you first enter health information in the course, on a screen separate from your agreement to our Terms of Service. Entering health information is optional, and the course is fully available to you without it. You can withdraw your consent at any time in the app’s Data & privacy panel or by emailing support@berine.io. When you withdraw consent, we stop collecting your health information, and you can delete what you have entered or ask us to delete it.

5. Sharing

We do not sell consumer health data, and we do not share it with third parties. It is stored by our database provider and handled by our hosting provider, each acting as our processor under a contract that limits its use of the data to providing services to us. If we ever offer a feature that would share your health information, such as sharing with your care team, we will ask for your separate consent before any sharing takes place.

6. Your rights

You have the right to:

  • Confirm whether we collect, share, or sell your consumer health data, and access that data, including a list of any third parties with whom it has been shared.
  • Withdraw your consent to our collection of consumer health data.
  • Have your consumer health data deleted. You can delete your course entries yourself at any time in the Data & privacy panel, or ask us to delete them. Deletion extends to our processors. Copies in backup systems are deleted on their normal cycle and in any event within six months.

To make a request, email support@berine.io from the email address on your account, or use the Data & privacy panel when you are signed in. We will verify your request through your account email and respond within 45 days. If we need more time, we will tell you why within that period, and we may extend it once by up to 45 additional days. We will not treat you differently for exercising any of these rights.

7. Appeals

If we decline to act on your request, you may appeal by emailing support@berine.io with “Appeal” in the subject line. We will respond in writing within 45 days, explaining any action we took or did not take and why. If we deny your appeal, you may submit a complaint to the attorney general of your state. Washington residents may submit a complaint at atg.wa.gov.

8. Changes and contact

We will update this policy if our practices change, and we will ask for your consent again before using consumer health data for a purpose not described here. Questions and requests can be sent to support@berine.io, or by mail to Berine Metabolic LLC, 2929 N Power Rd., Suite 101, Mesa, Arizona, 85215.
