Terms of Service
Last updated:
These Terms govern your use of Berine Metabolic, an educational platform operated by Integralife (“Berine,” “we,” “us”). By creating an account or purchasing a course, you agree to these Terms.
1. Acceptance of Terms
By creating an account, purchasing a course, or otherwise using Berine Metabolic, you confirm that you have read, understood, and agree to these Terms of Service and the Privacy Policy. If you do not agree, do not use the service.
You must be at least 16 years old to use Berine Metabolic. Berine Metabolic is not directed at children under 16.
2. Service Description
Berine Metabolic is an educational platform that delivers diabetes and metabolic-health courses authored by credentialed practitioners (Registered Dietitian Nutritionists and Certified Diabetes Care & Education Specialists). The platform delivers structured education, knowledge-check assessments, downloadable resources, and, when it launches, access to a peer community.
Berine Metabolic does not provide medical advice, diagnosis, or treatment. See §8 below for the full medical disclaimer.
Berine Metabolic also offers, or plans to offer, professional services to organizations, including staffing and embedded clinical support, consulting, and educational events. These business services are introduced on our work-with-us page and are governed by §13 below.
3. Account Terms
- One account per person. Accounts are non-transferable.
- You agree to provide accurate, current account information and to keep it current.
- You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
- Notify us promptly at support@berine.io if you believe your account has been compromised.
4. Purchase Terms & Refund Policy
Courses are sold as single, one-time purchases at the price shown at checkout. A purchase of the Diabetes Foundations course grants lifetime access for the purchaser. Purchases are not subscriptions and do not auto-renew. Pricing is presented in U.S. dollars; applicable taxes are calculated at checkout by Stripe Tax. Sales are offered only to consumers in the United States.
Your purchase grants you the personal, non-transferable license to access the course described in §5; it does not transfer ownership of the course or its content to you.
Because the course is digital content delivered immediately upon purchase, completing your purchase constitutes your express request for and consent to immediate access, and your acknowledgment that any right of cancellation or withdrawal that would otherwise apply once access begins is lost, except as provided by the limited refund window below.
Limited refund window. You may request a full refund within seven (7) days of purchase, provided you have not completed Module 3 or accessed content beyond it. After seven days, or once you have progressed beyond Module 3, all purchases are final and non-refundable. Refunds may be declined where account activity shows bulk downloading, scraping, credential sharing, or other access patterns consistent with content harvesting rather than personal study. Request a refund by emailing support@berine.io from your purchase email address.
The refund policy is disclosed prior to purchase as follows:
- On the course conversion page, in plain language near the purchase CTA.
- In the checkout flow, via a required consent checkbox acknowledging the refund policy before purchasing.
- In the purchase confirmation email.
The complete module-by-module curriculum is published on the course page and available for review before purchase. Reviewing the published curriculum is your opportunity to evaluate fit. Chargebacks are defended using your recorded consent, the pre-purchase policy disclosures described above, and the confirmation email.
Nothing in this Section limits or waives any refund or cancellation right that applicable law grants you and that cannot be waived by agreement; if applicable law entitles you to a refund notwithstanding this Section, we will honor it. We may also, in our sole discretion and without creating any obligation or precedent, issue a refund in cases of duplicate charge, unauthorized charge, or a failure of access we cannot remedy.
Berine may adjust pricing in the future. Existing purchases are honored at the originally paid price; new purchases are charged the then-current price. Promotional codes and referral discounts, when offered, are applied at checkout via Stripe.
5. Intellectual Property
All course content, including text, video, audio, illustrations, assessments, and downloadable materials, is owned by Berine Metabolic or its licensors and is protected by copyright and other intellectual-property laws.
Upon purchase, you receive a personal, non-exclusive, non-transferable, revocable license to access and use the course content for your own educational purposes. You may not:
- Reproduce, redistribute, publish, or commercially exploit any course content.
- Share account credentials, allow others to access content through your account, or resell access.
- Scrape, mirror, or otherwise extract content via automated means.
- Remove copyright, trademark, or attribution notices from any material.
B2B licensing for clinician or practice use is a separate written agreement. Contact support@berine.io to inquire.
6. User Conduct
You agree not to:
- Share your account credentials or transfer course access.
- Scrape, mirror, or redistribute course content.
- Use the platform to harass, threaten, or defame other users or Berine staff.
- Submit content that is unlawful, fraudulent, harmful, or that infringes the rights of others.
- Attempt to bypass security measures or interfere with the operation of the service.
- Use the service in any manner that violates applicable law.
7. Community Guidelines
The Berine community (when available) is a peer-support and education space. Community participation is governed by the following baseline rules; full community moderation policies will be published when the community launches.
- Treat other members with respect. No harassment, hate speech, or personal attacks.
- Do not provide clinical advice to other members. No member, including Berine staff, provides medical advice in the community.
- For crisis situations, contact your healthcare provider, call 911 (U.S.) or your local emergency number, or contact the 988 Suicide & Crisis Lifeline.
- Do not solicit, advertise, or recruit other members for unrelated services.
Berine may remove community posts or suspend community access for violations of these guidelines, at our discretion.
8. Medical Disclaimer
Berine Metabolic provides diabetes and metabolic-health education, not medical advice, diagnosis, or treatment.
Course content is authored by credentialed practitioners (RDN, CDCES) and aligns with current clinical guidelines at the time of publication. The content is designed to supplement, not replace, your relationship with your healthcare team. Berine is not your healthcare provider, and use of the platform does not create a patient-provider relationship.
No clinician-patient relationship. Authors’ credentials are disclosed so you know who wrote the material; they do not mean any Berine author is your dietitian, diabetes educator, or clinician. No dietitian-patient, clinician-patient, or other professional or fiduciary relationship is created between you and Berine or any Berine author by purchasing the course, reading or watching the content, or contacting us, even though the content is authored by licensed and credentialed professionals. No Berine author reviews, receives, or has any knowledge of your individual medical history, laboratory results, glucose data, or medications, and Berine does not provide individualized nutrition counseling, medical nutrition therapy, or treatment recommendations to any person.
General education, not tailored to you. Course content is prepared for a broad audience. It is not tailored to your diagnosis, medications, comorbidities, pregnancy status, kidney function, or other individual circumstances, and it may not be appropriate for you. Individual results vary, and Berine makes no promise of any particular health, laboratory, weight, or medication outcome.
You should consult your physician, certified diabetes care and education specialist, registered dietitian, or other qualified healthcare provider before making changes to your diabetes management, including changes to medication, diet, exercise, or monitoring routines. Never disregard professional medical advice, or delay seeking it, because of something you have read or watched on the Berine platform. If anything in Berine’s content conflicts with guidance from your own healthcare provider, follow your provider’s guidance.
Diabetes medication warning: if you take insulin, a sulfonylurea (such as glipizide, glyburide, or glimepiride), a meglitinide, an SGLT2 inhibitor, or any other glucose-lowering medication, changing what and when you eat can lower your blood glucose quickly and can cause hypoglycemia, which can be severe or life-threatening. Do not start, stop, reduce, increase, or otherwise adjust any medication or insulin dose based on Berine’s content. Talk with your prescribing clinician before you make dietary changes so that your medications and glucose monitoring can be adjusted and supervised by them.
Course content reflects clinical guidelines and evidence available as of the date of publication. Medicine and nutrition guidance change; Berine does not warrant that any content remains current and has no obligation to update it. Content on or reachable through third-party links is not reviewed or endorsed by Berine.
Berine Metabolic is not liable for any health outcomes, decisions, or actions taken in reliance on course content. You assume full responsibility for any decisions made based on the information you receive through the platform.
In a medical emergency, call 911 (U.S.) or your local emergency number immediately. Do not contact Berine for emergencies.
9. Limitation of Liability
To the maximum extent permitted by applicable law, and except as expressly stated in this Section, Berine Metabolic, Integralife, and our directors, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the platform.
Our aggregate liability for any claim arising from or related to these Terms or the platform shall not exceed the amount you paid for the course in the twelve (12) months preceding the claim, or two hundred U.S. dollars ($200), whichever is greater.
Exceptions. Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) gross negligence or willful misconduct; or (d) any liability that cannot be excluded or limited under applicable law. Residents of California are advised that California Civil Code section 1668 prohibits contractual exemption from or limitation of liability for fraud, willful injury to the person or property of another, or violation of law, and nothing in this Section is intended to operate as such an exemption or limitation.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some or all of the above exclusions and limitations may not apply to you; in that case, our liability is limited to the greatest extent permitted by law. For residents of New Jersey: the provisions of these Terms limiting or excluding liability and disclaiming warranties are void, unenforceable, or inapplicable in New Jersey to the extent they would limit rights that New Jersey law does not permit to be limited; all other provisions of these Terms are valid and enforceable in New Jersey.
10. Dispute Resolution & Governing Law
These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-laws principles.
Before bringing a formal claim, you agree to first contact us at support@berine.io with a written description of the dispute. We will attempt to resolve it in good faith within thirty (30) days.
If the dispute is not resolved through informal negotiation, claims arising from or related to these Terms or the platform shall be resolved in the state or federal courts located in Maricopa County, Arizona, and you and Berine consent to the jurisdiction of those courts, except that either party may bring an individual action in small-claims court for claims within that court’s jurisdiction, and except where applicable law gives you the right to bring a claim in the courts of your own state of residence.
To the extent permitted by applicable law, you and Berine agree that disputes will be resolved on an individual basis and not as part of a class, consolidated, or representative action. If this class-action waiver is found unenforceable as to a particular claim, it is severed as to that claim only, and the remainder of this Section continues in full force.
11. Termination
You may stop using Berine Metabolic at any time. You may request account deletion by emailing support@berine.io. Account deletion is processed as described in the Privacy Policy.
Berine may suspend or terminate your access to the platform if you violate these Terms, including but not limited to credential sharing, content redistribution, or harassment. We will provide notice where reasonably possible.
If your account is terminated for cause, you forfeit course access and any unused features. If termination is initiated by Berine for reasons other than your breach (for example, discontinuation of the service), we will provide reasonable notice and, where appropriate, a refund of the unused portion of any paid services.
12. Changes to These Terms
Berine may update these Terms from time to time. Material changes will be communicated by email to registered users at least thirty (30) days before they take effect. The “Last updated” date at the top of this page reflects the most recent revision.
Continued use of the platform after a material change takes effect constitutes acceptance of the updated Terms. If you do not agree to a material change, you may request account deletion before it takes effect.
13. Professional Services & Business Inquiries
Our work-with-us page describes professional services Berine offers or plans to offer to organizations, such as staffing and embedded clinical support, consulting, and educational or training events. The information on that page, including service descriptions, statistics, and any references to clinical credentials, billing or coding, or continuing-education eligibility, is general information for evaluation purposes. It is not an offer, a guarantee of outcomes, or professional advice.
Submitting an inquiry through the work-with-us form does not create a contract and does not establish any professional, clinical, employment, or advisory relationship between you, your organization, and Berine. Any engagement is subject to a separate written agreement signed by both parties, which will govern the scope, fees, responsibilities, and liability for that engagement and will take precedence over these Terms for that work.
Do not send confidential information. Please do not submit confidential, proprietary, or legally protected information, including any patient information or protected health information, through the inquiry form or by email before a written agreement is in place. Information you send to Berine before an engagement is executed is not received in confidence, and Berine assumes no obligation of confidentiality with respect to it. If we begin an engagement, confidentiality and any required data-protection terms will be addressed in the signed agreement.
References on this site to the professional credentials of Berine’s personnel describe their qualifications. They are not an offer or agreement to provide clinical care, medical nutrition therapy, or supervision to you, your organization, or your patients or members. Any such services, if provided, would be governed solely by a separate signed agreement and by applicable licensure requirements in the relevant jurisdiction.
Inquiry information you submit is handled as described in our Privacy Policy.
